Prosecutors Say Father Broke Infant's Jaw, Fractured Skull
ASTORIA, Ore. -- A father appeared in court Wednesday on a first-degree assault charge for allegedly cutting his infant child's tongue, fracturing his skull and breaking his jaw.
The trial for Jose Gutierrez continued in a Clatsop County courtroom and was expected to last through the week.
On June 9, the child's mother heard the child screaming and ran into the room to see what was wrong, according to court documents.
The mother found Gutierrez standing in the room near the baby, who was severely injured and she called 911, according to court documents.
Doctors found that the child had suffered a skull fracture, a torn tongue and a broken jaw, according to court documents.
After investigating, officers arrested Gutierrez.
District attorneys said Gutierrez's baby had to undergo major surgery to repair his tongue after police said his father cut it.
Gutierrez testified that the injuries were the result of a faulty pacifier, but experts testified that the injuries could only have come from intentional physical force.
First-degree assault is a Measure 11 crime and if Gutierrez is convicted he would serve a mandatory minimum of seven and a half years in prison.
