Anivia Cruz-Dilworth who allegedly provided illegal butt shots and used sealers such as Krazy Glue on the women got her case thrown out!
NJ.com reports, Anivia Cruz-Dilworth, the New Brunswick, NJ model indicted last year for illegally providing buttocks-enhancing injections, will receive a temporary reprieve after a judge tossed out her case today for a faulty indictment.
“The statute pursuant to which she was charged has five subsections,” said defense attorney Thomas Ashley. “The indictment did not specify which subsection the grand jury found she had violated.”
Therefore, Ashley said, Cruz-Dilworth could not be expected to mount a defense.
Newark Superior Court Judge Michael Petrolli tossed the case out today on those grounds. The Prosecutor’s office has the option of re-indicting.
Anivia Cruz-Dilworth, 28, owns “It’s Anivia” cosmetics and skin care line. She is under contract with a major modeling agency. She allegedly assured several women who went to her for buttocks-enhancement injections that she was a trained professional, authorities said.
A months-long investigation into the allegations revealed Cruz-Dilworth had injected the women with what she described as a hydro-gel, a solid, jelly-like material that caused serious bacterial infections, including cellulitis and necrosis, said Essex County Assistant Prosecutor Peter Sepulveda. An investigator with the U.S. Food and Drug Administration also assisted, but the substance used, at first thought to be similar to bathtub caulk, was never conclusively determined.
The injections were sealed with liquid adhesives such as Krazy Glue, prosecutor’s alleged. Cruz-Dilworth allegedly charged up to $1,250 for the procedure.
Cruz-Dilworth would “use a syringe, mark them, inject them, then use Krazy Glue to seal it,” Sepulveda said.
“In light of the judge’s decision we’re going to review the case and make a decision in the future as to whether or not we will re-indict the defendant or take another course,” said Katehrine Carter, a spokeswoman for the Essex County Prosecutor’s Office.
